1. The Service

• Purpose. AI Sharks is a business evaluation platform that allows entrepreneurs to pitch their business ideas to 4 specialized AI Sharks. The App provides instant evaluation scores, feedback, and a suite of business analysis tools including SWOT, PESTLE, competitor analysis, financial modeling, marketing strategy, and launch planning. Users can also export a comprehensive business plan as a PDF.
• Platform requirements. AI Sharks requires an iOS device and an active internet connection. Some features require an active subscription. Availability may vary by region.
• No professional advice. The App is not a substitute for professional business, financial, legal, or investment advice. AI-generated evaluations and analysis are for informational purposes only. Always consult qualified professionals before making significant business decisions.

2. Accuracy of Information

The App generates business evaluations, analysis, and plans using large language model (LLM) technology for general informational purposes only. Neither AI Sharks nor its affiliates represent or endorse the accuracy or reliability of this information. No warranty of any kind, express or implied, is made regarding the completeness, accuracy, or suitability of any AI-generated content. You assume full responsibility for any reliance on such information.

3. Registration and Account

To access the full features of the App, you must create an account. You agree to provide accurate and complete information and to keep it up to date. You are responsible for all activity under your account and for maintaining the security of your login credentials. You may delete your account at any time by contacting us at hi@aisharks.xyz.

4. Subscriptions, Purchases & Trials

• Plans. AI Sharks offers different subscription tiers. Access to specific features, including advanced Shark workspace tools and PDF export, is subject to the plan you select.
• Billing. Paid plans are billed via the Apple App Store. We do not store your financial information on our servers.
• Auto-renewal. Subscriptions renew automatically at the end of each billing period unless canceled at least 24 hours before the renewal date. Manage or cancel in your iOS account settings. Deleting the App does not cancel a subscription.
• Free trials. If a free trial is offered, it will convert to a paid plan unless canceled before the trial ends.
• Refunds. Refunds are governed by Apple's App Store policies. We cannot issue or override App Store refunds. Contact Apple directly for billing disputes.

5. Your Business Ideas & Content

You retain full ownership of the business ideas you submit and the analysis reports generated for you within the App. You grant us a limited, non-exclusive license to process your inputs solely for the purpose of delivering the App's services to you (e.g., generating Shark evaluations). We will not use your specific business ideas for our own commercial purposes or share them with third parties except as necessary to generate the AI responses.

6. Prohibited Content and Conduct

You may not use the App to submit or transmit any content that is:

• Unlawful, harmful, or promoting unlawful activity.
• Defamatory, discriminatory, or harassing toward any individual or group.
• Spam, unauthorized advertising, or fraudulent content.
• Infringing on any party's intellectual property or proprietary rights.
• Designed to circumvent, damage, or interfere with the App's security or functionality.

Violations may result in immediate account suspension or termination without notice.

7. AI-Generated Content

The App's AI Shark evaluations, scores, and business plan content are generated by large language models. This content may be inaccurate, incomplete, or not reflective of real-world conditions.

No investment or business advice. AI outputs are for informational and planning purposes only and do not constitute financial, investment, or legal advice. Do not make significant business or financial decisions based solely on AI-generated content.

Your license. Subject to these Terms, we grant you a personal right to use AI-generated outputs within the App. You may export and share your business plan PDF, but you may not misrepresent AI-generated content as advice from licensed professionals.

8. Disclaimer of Warranties

THE APP AND ALL FEATURES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. AI SHARKS DOES NOT WARRANT THAT THE APP WILL MEET YOUR REQUIREMENTS, DELIVER SPECIFIC OUTCOMES, OR OPERATE WITHOUT INTERRUPTION OR ERROR.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AI SHARKS AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP OR RELIANCE ON ANY AI-GENERATED CONTENT, EVEN IF AI SHARKS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

10. Intellectual Property

The App, its design, software, trademarks, and all content created by AI Sharks are owned by us or our licensors and are protected by applicable intellectual property laws. Except for the limited license above, no rights are granted to you. If you provide feedback or suggestions, you grant us a perpetual, royalty-free license to use them without obligation to you.

11. Privacy

Your use of the App is governed by our Privacy Policy. By using the App, you acknowledge that we may process your information as described there.

12. Changes to the App or Terms

We may modify or discontinue features at any time. We may update these Terms from time to time and will notify you of material changes via an in-app notice or email. Your continued use after changes become effective constitutes acceptance of the updated Terms.

13. Apple App Store Terms

If you downloaded the App from the Apple App Store, you acknowledge that (a) these Terms are between you and AI Sharks, not Apple; (b) Apple has no obligation to provide maintenance or support for the App; and (c) Apple and its subsidiaries are third-party beneficiaries of these Terms with the right to enforce them.
